The Applicant is seeking his release on bail in connection with C.R.No.159/2018 registered at Velha police station, District Pune which had resulted in Sessions Case No.309/2019 on the file of the Additional Sessions Judge, Pune.

At the outset, learned APP points out that the Applicant is released on temporary bail in view of spread of COVID-19. Therefore, as on today the Applicant is on interim bail. Learned counsel for the Applicant also concurs with this statement. He produced a copy of the order dated 26.5.2020 Deshmane(PS)

Learned counsel for the Applicant, therefore, prays for withdrawal of this application on merits at this stage and seeks liberty to file fresh application on merits once the Applicant's interim bail comes to an end and once he surrenders before the jail authorities. Learned APP does not have any objection for this course of action. Hence, the following order :

ORDER

(i) The application is allowed to be withdrawn with liberty to the Applicant to prefer fresh application on merits after he surrenders by PRADIPKUMAR PRAKASHRAO DESHMANE Date:

2021.11.22 16:58:49 +0530 before the jail authorities once his interim PRADIPKUMAR PRAKASHRAO DESHMANE bail gets over.

(ii) The Application stands disposed of accordingly.
