Today, the learned APP has placed on record the Roznama in Sessions Case No. 279 of 2016, pending before the City Civil Court, Mumbai. It appears that on 20th June 2017, the substantive evidence of PW-1 is partly recorded. The trial has commenced. In view of this, it would not be appropriate to consider the application under Section 439 of Cr.P.C. Hence, the application stands rejected and disposed of. The earlier application was withdrawn on 7th February 2017.
