This is an application received through Jail for expediting the trial of the applicant pertaining to Sessions Case No.84/2013 and for providing him medical facility in pursuance of the order dated 12.4.2017 passed by this Court. The learned Additional Sessions Judge, Borivali Division, Dindoshi, Mumbai has submitted a report dated 24.4.20178. The report indicates that the Advocate for the applicant is seeking adjournments to give his reply and to argue the matter whenever questions are put to him. The delay is being caused in concluding the said trial is entirely at the behest of the applicant and his Advocate. It further clearly indicates that the applicant has already been Page-1/2

8-appln. 718-16 convicted in Sessions Case No. 762/2004 by the leaned Sessions Judge at Sewree and has been sentenced to suffer simple imprisonment for 10 years. It appears that the applicant is not under going the said sentence as he is being considered under trial prisoner in the present case. It further appears from the record that under the orders of the Trial Court the applicant was provided with necessary medical assistance from the Jail administration and also at J.J. Hospital at Mumbai.

In view of the above, no further directions are necessary.

The application being misconceived is accordingly dismissed.
