This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

I have heard the learned counsel for the applicant and the learned APP for the State.

On 9 December 2022, this Court passed the following order: "

This is an application under Section 438 of Code of Criminal Procedure.

2. The applicant is apprehending his arrest in Crime No. 43 of 2022 registered at Shivaji Nagar police station for the offences punishable under Sections 419, 420, 506 read with 34 of Indian Penal Code.

According to the complainant the co-accused in the present crime had induced him to deposit Rs. 19,70,886/- for purchase of bitcoins and after deposit of the said amount they deceived him by not crediting the bitcoins to his wallet. The said amount of Rs. 19,70,886/-was deposited in the bank account of the applicant.

4. The learned counsel for the applicant submits that he has nothing to do with the alleged crime. It is submitted that the co-accused Shabir Shaikh had borrowed Rs. 5,00,000/- from him. He took bank account details of applicant for depositing the said amount. The learned counsel for the applicant submits that thereafter on 19 November 2020 the applicant found that somebody had deposited amount of Rs. 19,70,886/- in his bank account. It is submitted that on the very same day he received message from co-accused Shabir Shaikh to transfer the amount of Rs. 8,50,000/- to the bank account of one P.A. Rao and Rs. 1,00,000/- to the bank account of Salma Begam. It is submitted that the applicant had accordingly transferred the said amount. It is further submitted that on the very same day i.e., on 19 November 2020 itself the bank account of the present applicant was freezed.

5. The learned APP seeks time to verify the abovesaid facts.

6. Considering the facts and circumstances, I am inclined to release the applicant on interim anticipatory bail till the next date.

In the event of arrest of the applicant in Crime No. 43 of 2022 registered at Shivaji Nagar police station for the offences punishable under Sections 419, 420, 506 read with 34 of Indian Penal Code, he shall be released on bail on furnishing PR bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

8. The applicant shall attend the concerned police station from 13 December 2022 to 15 December 2022 and shall co-operate in the investigation.

9. List the application for further consideration on 21 December 2022."

The learned counsel for the applicant submits that the applicant pursuant to the order passed by this Court dated 10 February 2023, has deposited the amount of Rs. 5 Lakhs. Considering the overall facts and circumstances, interim order passed by this Court dated 9 December 2022 is hereby confirmed.

The applicant shall attend the concerned police station as and when called by the Investigating Officer and shall co-operate in the investigation. 6.

Application is disposed of.
