This is an application seeking cancellation of bail granted to the Respondent vide order dated 28th April, 2014. 3.

The learned APP submits that the Respondent has committed breach of conditions imposed upon him while granting bail. It is submitted that while on bail in Criminal Appeal No. 367 of 2012, the Respondent is involved in another offence of similar nature and is shown as an accused in C.R. No. 42 of 2017 registered on 9.7.2017 by the Anti Narcotic Cell, Worli Branch. 4.

The learned counsel for the Respondent submits that the Respondent herein is a senior citizen and that after conclusion of investigation in C.R. No. 42 of 2017, it is committed before the Special Court and registered as Special Case No. 3 of 2018. 5.

In view of this, the bail granted vide order dated 28th April, 2014 deserves to be cancelled/recalled.

The Respondent shall be shown to be in custody in Criminal Appeal No. 367 of 2012 from 7th December, 2018. The Application is allowed in the above terms and stands disposed of. [SMT.SADHANA S. JADHAV, J.] V.A. Tikam
