Advocate for the respondents states that the present Appeal from Order is filed by the original plaintiff challenging the order dt.5.9.2013 in Notice of Motion No.2553 of 2011 in Suit No.1447 of 2011. He submits that the suit No.1447 of 2011 is dismissed by the trial court on 15.09.2014. Hence, nothing survives in the present Appeal. These facts are not disputed by the advocate for the appellant.

Hence, Appeal from Order is dismissed as infructuous.
