DATE : December 12, 2018 Civil Application No.4270 of 2018 The claimants seek permission to withdraw the amount of compensation deposited by the appellant.

Perused the impugned judgment as well as the order dated 04/10/2018 passed in connected appeal.

The claimants are permitted to withdraw 50% of the amount of compensation as deposited subject to filing an undertaking within eights weeks that in case the appeal is allowed, said amount shall be repaid with interest at such rate the Court may direct. The remaining amount shall be invested in Fixed Deposit.

Civil application is allowed and disposed of. Civil Application No.1379 of 2016 The applicant to take necessary steps with regard to service on respondent No.4 within period of four weeks from today. Asmita (A.S.CHANDURKAR,J.)
