P.C:- This Petition challenges the order dated 2nd September, 2013 passed by the Divisional Commissioner, Kokan Division, Mumbai. By the impugned order, the Petitioner's application to disqualify Respondent No.1 from membership of the Bhiwandi Nizampur City Municipal Corporation, in terms of the Maharashtra Local Authority Members Disqualification Act, 1986 was rejected. The term of the earlier Corporation has expired and the next election to the Corporation has already been held.

Therefore, Mr. Mhatre, learned Counsel appearing for the Petitioner, is instructed not to press the present Petition. Accordingly, Petition is disposed of as infructuous. (M.S.SANKLECHA,J.) S.R.JOSHI
