This is an application for fixing the date of hearing of the Criminal Revision Application No. 435 of 2016. The Applicant had preferred the criminal revision application, challenging the order rejecting the application for discharge. The Applicant has been prosecuted for the offence punishable under Section 306 r/w. 511 of the Indian Penal Code. 2.
The learned counsel for the Applicant submits that the revision has been admitted and the proceedings were stayed. It is submitted that the Applicant is a bank employee, who was persuading the first informant to repay the credit card dues of the bank. It is submitted that the first informant had committed suicide by consuming sleeping peels. It is 1/2
Tikam APPR 605 of 2017 submitted that the aforesaid provisions are not attracted to the present case and in the peculiar circumstances, the date may be fixed for hearing the matter.

The learned APP for the State has no objection if the matter is fixed for hearing.

Taking into consideration the nature of allegations and also taking into consideration the fact that the Applicant is a bank employee, the revision application can be directed to be fixed for hearing. Hence, I pass the following order:
ORDER
(i) The Criminal Application No. 605 of 2017 is allowed. (ii) The Criminal Revision Application No. 435 of 2016 may be added to the final hearing board commencing from 5th February, 2018. Criminal Application is disposed of accordingly. [PRAKASH D. NAIK, J.] Tikam 2/2
