In Crime No.242/2018 lodged by the non-applicant against the applicant for offences punishable under sections 354 and 506 of the Indian Penal Code and under section 8 of the Protection of Children from Sexual Offences Act (POCSO Act)
2 14) ba2984-18.doc registered with Versova police station, Mumbai, the applicant came to be arrested on July 7, 2018.

Charge-sheet in the matter is already filed.

Considered the allegations against the applicant as reflected in the F.I.R. The applicant is the husband of the complainant and the victim girl is his daughter. 4.
The complainant is personally present in the Court and is identified by her lawyer. The complainant has also produced original Aadhar Card No.7450 92569 2804 and Pan Card No.GHDPS5141A for perusal of the Court. Xerox copies of the Aadhar Card and Pan Card certified by the lawyer for the complainant are taken on record along with the affidavit. 5.
As the charge-sheet in the matter is already filed and having regard to the no objection extended by the complainant and the nature of allegations, in my opinion, the custodial detention of present applicant is not warranted. Hence the order. i) The applicant be released on bail in Crime No.242/2018 for offence punishable under sections 354 and 506 of the Indian Penal Code and under section 8 of the POCSO Act registered
3 14) ba2984-18.doc with Versova police station, Mumbai upon his furnishing P.R. Bond of Rs.15,000/- with two sureties in the like amount; ii) He shall not influence or tamper with the prosecution witnesses;
iii) The application is disposed of accordingly.
