We had passed a detailed order yesterday being deeply pained with the impugned action being reported against the petitioners. 2.
We have heard learned counsel for the parties on the backdrop of our order dated 8th November 2023. We appreciate the decision taken by Dr. B. B. Chavan, Chairman who has informed the learned Assistant Government Pleader by his communication dated 9th November 2023 that the impugned order dated 26th October 2023 is been withdrawn. He has also expressed concern in regard to the petitioners being required to approach this Court. We appreciate the fair stand taken by the said officer having withdrawn the impugned order. Needless to observe that a formal order in this regard be issued and communicated to the petitioners.

Since the order is withdrawn, further adjudication of the petition is not called for.

We may also refer to statement made by the learned Assistant Government Pleader. Insofar as the petitioner Smt. Pushpalata Prataprao Aher is concerned, she was receiving monthly pension, Shri. Kishor Sukhdev Sonawane is concerned, he was received monthly salary in the pay scale and Smt. Suhasini Raghunath Shinde is concerned, her salary grant to the extent of 80% was being released for the post of
Assistant Teacher. Insofar as rest of the petitioners are concerned, 20% grant was sanctioned.

In view of the fair stand taken by the officer, we recall our order dated 8th November 2020. It shall not be taken into consideration and / or acted upon for any purpose.
