Heard the learned counsel for the applicant and the learned APP.

This is an application under Section 438 Code of Criminal Procedure. The applicant herein is apprehending his arrest in Crime No.404 of 2017, registered at Kharghar Police Station for the offences punishable under Sections 143, 144, 147, 149, 324, 326 and 504 Indian Penal Code. There are cross complaints It is a matter of record that Crime No.406 of 2017 was registered at the behest of the complainant in respect of the same incident. It appears that the

Dusane 2/2 53 aba 2110.2017 incident had occurred on the spur of moment. On 19th December 2017, this Court had granted interim relief to the applicant and had directed the applicant to report to the police station on every Wednesday and Sunday between 10.30 am. to 12.00 noon and shall not visit Kharghar Gurdwar till the next date. Learned APP, upon instructions submits that the applicant has abided by the said order. In view of this, the order dated 19th December 2017 deserves to be confirmed on same terms and conditions except that the applicant shall not visit Kharghar Gurdwar till filing of the charge-sheet.

The applicant shall report to the concerned police station as and when called.

The application is allowed in above terms and stands disposed of.
