There is delay of 70 days in bringing the legal representatives of the deceased on record. Abatement is set aside and the delay is condoned.

The applicant is permitted to bring legal representatives of the deceased appellant (who is also respondent in First Appeal No. 685 of 2003) - Milind Laxman Bhat on record namely- Neha Milind Bhat and Ankit Milind Bhat.

Necessary amendment shall be carried out in both the appeals within a period of two weeks.

After carrying out the necessary amendment, amended copy of the memo of appeal shall be served upon the respondents. 6.
