Heard. This application is for restoration of Writ Petition No.10588/2016 which was dismissed for default vide order dated 23.11.2016.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. At the same time, the applicant has to pay cost of Rs.2500/-. Cost to be deposited in the office of the Maharashtra State Legal Services Authority, High Court, Bombay, within two weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court.

Hence, the following order:

a) Order dated 23.11.2016 passed in Writ Petition No.10588/2016 is recalled.

b) The Writ Petition stands restored to file for hearing on merits.

c) The applicant has to pay cost of Rs.2500/-.

d) Cost to be deposited in the office of the Maharashtra State Legal Services Authority, High Court, Bombay, within two weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court. e) Civil application stands disposed off accordingly.
