Heard the learned counsel for the Petitioner. 2.

The Petitioner seeks direction against the Respondents to develop Plot No.20, Sector No.41 of Dronagiri Node, Uran, District Raigad ad-measuring 899.97 sq. meters..

Perusal of the additional afÏdavit filed by CIDCO transpires that the Petitioner has mortgaged the Plot No.20 i.e. the writ plot. The afÏdavit further proceeds that unless the mortgage is cancelled the process of cancelling the existing plot and the process of the alternate plot cannot be initiated. The learned counsel for the Petitioner submits that Petitioner has initiated process for cancellation

Priya Soparkar 2 42 wp 2674-20-c of mortgage over the said plot and it may take about four to six weeks to conclude the process.

The afÏdavit of CIDCO proceeds further and states that after cancellation of mortgage, process for cancelling the original plot and thereafter initiating the process for alternate plot can be undertaken.

After the mortgage over Plot No.20 (writ plot) is cancelled, the Petitioner may make an application to the CIDCO for allotment of the alternate plot. The CIDCO shall consider the said application of the Petitioner for allotment of alternate plot expeditiously. 6.

The Writ Petition is disposed of. No costs.
