The learned counsel for the Appellants submits that by this First Appeal under Section 23 of the Railway Claims Tribunal Act, 1987, Claimants are challenging judgment dated 31st August 2018 passed by the Railway Claims Tribunal, Mumbai in claim petition No. 212 of 2012, dismissing claimants application for compensation. 3.

Considering the submissions made by the learned counsel for the Appellants and the impugned judgment I am satisfied that he Appellants have made out a case for following order: a.
