By this petition, the petitioner seeks quashing and setting aside of the First Information Report registered vide C.R. No.26 of 1998 with the Anti Narcotic Cell, Mumbai for the alleged offence punishable under sections 21, 29 r/w Section 8 (c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned A.P.P, on the instructions of Mr. Awale and Mr. Pavale, P.S.I, attached to the Anti Narcotic Cell, Azad Maidan Unit, Mumbai submits that after investigation, the Police have not found any evidence against the petitioner nor his complicity is seen in the commission of the aforesaid offence. He submits that considering the same, the Police will be filing an appropriate report before the concerned Court. Learned A.P.P has tendered a report of Mr. Pramod Awale, P.S.I evidencing the same. The said report is taken on record.

In view of the statement made by the learned A.P.P, nothing survives for further consideration in the aforesaid petition. Accordingly, the petition is disposed of.

Needless to state that the petitioner is at liberty to file a fresh petition, if the occasion so arises, in future. 6.
