The writ petition arises out of rejection of temporary injunction application filed by the petitioner restraining defendants from creating third party rights in relation to the suit property. Respondent No.1 has filed affidavit stating that he shall not sell the suit flats during the pendency of the suit without permission of the Trial Court.

The statement in the affidavit in reply dated 21 October 2023 is accepted. The statement shall operate as interim relief during the pendency of the suit.

In view of said statement, nothing remains to be adjudicated in the writ petition.
