P.C. :- This is an application under Section 438 of Cr.P.C. The applicant herein is apprehending his arrest in crime No.68 of 2014 registered at Alandi Devachi Police Station for the offences punishable under sections 307, 504, 506 34 of I.P.C. Learned counsel for the applicant had approached the Court of sessions under section 438 of Cr.P.C. Initially he was granted interim relief, however, application was finally rejected on 3rd December 2014. The learned counsel for the applicant upon Waghmare

O R D E R

(i) Application stands dismissed as withdrawn. (ii)The applicant herein is protected till 5.00 p.m. of 27th January 2015.

(iii) The learned Magistrate shall not be influenced by the withdrawal of this application and shall consider the application filed by the applicant under section 437 of Cr.P.C. and decide the same on its own merits.
