By this petition, the petitioner/accused no.2 is praying for directing the learned Metropolitan Magistrate, 37th Court, Esplanade, Mumbai, to expedite the trial of Criminal Case No.517/PW/2012.

The learned counsel for the petitioner/accused no.2, by drawing my attention to evidence of PW7, has argued that after avk 1/2

11-WP-6133-2019.doc deferring the cross-examination of the said witness on 8th December 2016, there is no further progress in the trial. I have considered the submissions so advanced and also perused the roznama of the subject criminal case. It is seen from that roznama that on not a single date, the petitioner/ accused no.2 appeared before the trial court. It is also seen from the roznama that the learned trial court had never adjourned the matter suo moto. It seems that adjournment is at the instance of the accused.

In this view of the matter, the petition is disposed off with a liberty to the petitioner to move an appropriate application before the learned trial court for expediting the trial. If such an application is preferred, the learned trial court to decide the same according to provisions of law. (A. M. BADAR, J.) Arti V.
