The learned counsel for the Appellants submit that the Appeal was dismissed for want of non-compliance of the order dated 16th September, 2011. The Appellants have failed to file the paper book within one year from the date of the order. He submitted that the Appeal was dismissed before issuance of the notice. He further submits that his paper book is now ready.

This Appeal was dismissed on 15th September, 2012 pursuant to the order passed by Vishal 1 of 2

prod-6-caf-2160-2015.doc the Court on 16th September, 2011. There is delay of nearly two and half year in filing the application for restoration. However, the Appeal is admitted and the order of dismissal has taken place before issuance of notice to the other side. Hence, the Appeal is restored.

Issue notice to the Respondents returnable on 23rd December, 2015. The paper book is to be filed within three weeks. If not filed, the Appeal will be dismissed without further reference to the Court.
