There is a delay of a year and 42 days in filing the First Appeal. The Civil Application is served. It is opposed. I find from that is stated in the First Appeal that sufficient cause is made out. The Applicant states that time was lost in contacting his Advocate who appeared in the MACT, Karad and collecting papers from him to engage fresh representation. I am satisfied that the delay is not deliberate nor due to negligence. The delay is condoned. 2.

The Civil Application is disposed of in these terms. There will be no order as to costs.
