The challenge in this petition is to the order dated 11.12.2015 made by the Family Court in Petition No. A-322/2014. In terms of this order the petitioner-husband has been directed to grant Christmas Vacation access to the respondent-wife in order to meet and spent some time with children Tvisha and Krishav.

Ms. Komal - Respondent wife now stated that the family court in June 2016 has restored the custody of the two children to her. This order was challenged by the petitioner before this Court but the challenge failed on 12.07.2016. From 13.07.2016 the physical custody of the children is with her.

If, aforesaid is the position, then the present petition has clearly become infructuous. Therefore, relying upon the statement made by Ms. Komal with regard to the aforesaid subsequent development, the present petition is disposed of as having become infructuous. 5.
