CORAM : P.V. HARDAS & P.N. DESHMUKH, JJ.
DECEMBER 24, 2013.
P.C. :- It appears that the bail granted to the Applicant has been continued from time to time by granting liberty to the Applicant to apply for further extension in the event there was no improvement in his medical condition. This Court, by its order dated 10th December 2013 had also granted further extension of the bail which had been extended by order dated 28.8.2013. By the aforesaid order i.e. by order dated 10th December 2013 we had extended the period of the bail from 11th December 2013 till 15th June 2014. Unfortunately, it appears that through oversight, liberty to
APPA 1795.13.sxw the Applicant for seeking further extension if the circumstances so justified, was not stated by us in the said order.
2.
The present Application therefore has been moved seeking clarification as well as seeking liberty to apply for further extension after the expiry of the period of the extended bail i.e. which would expire on 15th June 2014. 3.
Since liberty has been granted to the Applicant for seeking extension of the bail by the earlier orders passed by us, we clarify that the extension of bail by our order dated 10th December 2013 from 11th December 2013 to 15th June 2014 would be with liberty to the Applicant to apply for further extension, if his medical condition so justified. 4.
We accordingly allow the present Application as indicated above.
