Petitioner submits that he complained to the police of Khandeshwar Police Station that he was assaulted by the accused and instead of prosecuting the accused, the police filed report (N.C.) at Annexure "B", page 16, to the petition. The petitioner submits that to put pressure on the petitioner, a complaint has been registered against the petitioner.

We have perused the original record maintained by the police and the injury certificate. The Learned APP submits that the complaint has been received against the petitioner filed by one lady on 23/3/2016, which was registered by the Khandeshwar Police Station. The petitioner filed a complaint on 16/3/2016, which was registered by the Railway Police Station, CST, Mumbai, against unknown person. 3.
As the N.C. is registered on the complaint of the petitioner, the petitioner may resort to appropriate alternate remedy prescribed under law. All issues on merits are kept open.

Petition is disposed of accordingly.
