This is an application for pre-arrest bail in connection with C.R.No. I-276-2019 registered with Wada Police Station, Palghar, for the ofences punishable under Section 498-A, 306 read with Section 34 of the Indian Penal Code.
The applicant married deceased Akshada on 28/5/2018. On 24/10/2019, Akshada @ Sai committed suicide at her matrimonial house when she was alone and left a suicide note. The First Information Report (FIR) was lodged on 24/10/2019 by Akshada's father against the applicant. There are allegations of harassment and ill-treatment. It is alleged that sometime in 1/3
2018, the complainant had sold his agricultural land to comply with the monetary demands made by the applicant. It is alleged that the applicant was ill-treating Akshada for this reason, therefore, Akshada took the extreme step as she could longer bear the harassment.

This Court on 20/1/2020 passed the following order : 1.
Heard. It is alleged that the applicant has abated and/ or intentionally aided his wife to commit suicide. She had left behind a note wherein she made no allegations against the applicant.
The learned APP on instructions seeks time to verify the allegations made by the deceased's father and in particular whether he had sold the land and satisfed the demands of the applicant. Time granted.
In the meantime, in the event of arrest of the applicant, in C.R. No.I-276/2019 registered with the Wada Police Station, Palghar, the applicant be released on bail, on furnishing P.R. Bond of Rs.20,000/- (Rs. Twenty Thousand only) with one or two sureties in the like sum. 4.
The applicant shall co-operate with the investigation and attend the concerned Police Station as and when called. 5.
Stand over to 20th February, 2020.

In terms of paragraph 2 of the order dated 20/1/2020, the statement of the informant is recorded on 2/11/2021 by the investigating ofcer. In the said statement, the informant states 2/3
that the agricultural land was sold, however, the same was for helping the applicant in his business. In the suicide note left behind by Akshada, there are no allegations made against the applicant.

In the facts of the present case I am satisfed that custodial interrogation of the applicant is not necessary. Hence the following order :
ORDER
1.
Interim order dated 20/1/2020 is confrmed.
In the event of arrest of the applicant in Crime No.I-2762019 registered with Wada Police Station, Palghar, the applicant be released on bail on his executing PR bond of Rs.20,000/- with one or two sureties in the like amount.
The applicant shall co-operate with the investigation and shall attend the concerned police station as and when called. 4.
The application is disposed of.
