This application is filed for condonation of 210 days delay in filing the above Family Court Appeal. By order dated 30.03.2015, notice was issued to the respondent with liberty to the applicant to serve the respondent privately. The applicant has accordingly served the respondent by private service and filed affidavit of service. Despite this, the respondent has remained Uday S. Jagtap

101-15-cam=.doc absent. Otherwise also, we find that averment made in paragraphs 3 to 5 are sufficient to condone the delay in filing the aforesaid appeal.

Therefore, Civil Application is allowed in terms of prayer clause (b). The delay of 210 days in filing the appeal is condoned. 4.

Registry to place the Family Court Appeal on board for admission on 24th July, 2015.
