This is an application for suspension of sentence and releasing the applicants on bail.

The applicants have been convicted under Section 399 and 402 r/w 34 of the Indian Penal Code and sentenced to suffer rigorous imprisonment for seven years by the learned Ad-hoc District Judge-3 and Asstt. Sessions Judge, Pune by its Judgment and Order dated 28.09.2011 in Sessions Case No.762 of 2010. The Criminal Appeal No.414 of 2011 preferred by the applicants has been dismissed by the learned District Judge-4 and Additional Sessions Judge, Pune by its Judgment and Order dated 18.11.2017 and the applicants have been taken into custody on the same Aarti Palkar 1/2

It is submitted by the learned Counsel for the applicants that, till date the applicants have already undergone a sentence of approximately 8 months. As the maximum sentence imposed upon the applicants is of 7 years, I am inclined to release the applicants on bail. Hence, the following order :- (i).
The applicants be released on bail in C.R.No.182 of 2010 registered with Khadki Police Station, Pune culminated into Sessions Case No.762/2010, the applicants shall be released on bail on their furnishing PR Bond in the sum of Rs.25,000/- each with one or two separate solvent local sureties in the like amount.
(ii) After released from jail, the applicants are directed to attend the Khadki Police Station, Pune, once in a 3 months on every 1st Monday of the month between 10.00 a.m. to 2.00 p.m. and to mark their presence. 4.
