In Crime No. I-329 of 2016 registered with Rabale MIDC Police Station, Thane for the offences punishable under Sections 306, 452, 323, 504 read with Section 34 Indian Penal Code, the applicant, a Manager of Co-operative Bank is seeking pre-arrest bail. One deceased, Sitaram Pothbhare committed suicide on October 8, 2016 who had admittedly taken loan from the Bank of

Rane * 2/2 * ABA-2166-2016 Wednesday,21.12.2016 sr.no.901 which the applicant is the Manager. Deceased, Sitaram Pothbhare scribed a suicide note and in specific terms named the present applicant as one of the persons responsible for his suicide. In the suicide note, it is mentioned that it is the other co-accused in connivance with the applicant processed his loan application, took commission out of the said amount of loan sanctioned to him and then harassed him for repayment.

The applicant with a specific role his named in the suicide note. In my opinion, no case for bail is made out. Hence, the Bail Application is rejected.
