It is an application under Section 439 of Code of Criminal Procedure, 1973.

Applicant was released on bail on 19.11.2008 in Crime No.140/2008 registered with Wagale Estate Police Station, Thane. The learned Judicial Magistrate, First Class, Thane issued a non-bailable warrant against the applicant which was executed on 13.11.2019 for not attending the

2/3 Court and since then, he has been in judicial custody. Applicant is seeking enlargement on bail. 3.

Learned counsel, on an assurance from nephew of the applicant submits that the applicant shall attend the proceeding in R.C.C. No. 1598/2009 regularly and shall file an undertaking before the trial Court within seven days from his release from jail. To that effect, in view of the assurance and undertaking, applicant is directed to be released on bail on following conditions.

O R D E R

(i) The applicant is directed to be released on bail on executing P.R. Bond for the sum of Rs.10,000/- with one or more sureties for the like sum;

(ii) The applicant shall furnish particulars of his residential address and contact details to the investigating officer as and when required; (iii) The applicant shall not tamper with the

3/3 evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case;

The application is allowed in the aforesaid terms and disposed off.
