Today the matter is shown on production board as per praecipe dated 16th September, 2019 filed by the advocate for the Applicant. 2.

By this Civil Application No. 980/2014, the Applicant insurance company is seeking condonation of 6 days delay in filing the First Appeal challenging the Judgment and award dated 2nd August, 2013 passed by the Motor Accident Claims Tribunal, Nashik in Motor Accident Claim Petition No. 397/2009 holding that the Respondents/Original Claimants are entitled to sum of Rs. 1,34,373/- by way of compensation with interest @ 6% p.a.

The Learned Counsel for the Applicant submits that, he has received instructions from his client to withdraw the present First Appeal and Pending Civil Laxmi Sontakke

501 CA 980-14 Applications. To that effect he has given in writing. The same is taken on record and marked as 'X' for identification. The same is accepted. 4.

The Civil Applications as well as First Appeal stand disposed of as withdrawn. 5.

Refund Court fees as per rule.

If any amount is deposited by the Applicant insurance company in the Registry of this Court then the said amount to be transferred to the Motor Accident Claims Tribunal, Nashik in the account of Motor Accident Claim Petition No. 397 of 2009 for withdrawal.

No order as to costs.
