By this Writ Petition, it is prayed that the order dated 7.10.2016 passed by the learned District Judge 15, Pune, thereby setting aside the order dated 24.3.2015 passed below exhibit 54 and also the order dated 11.12.2013, below exhibit 50, of clubbing the two suits, are to be set aside. The learned Counsel for both the sides, by consent, submit that they will go before the trial Court and will argue exhibit 50 afresh.

In view of the above, the trial Court is directed to rehear the exhibit 50 and pass order afresh. The parties to appear before the

wp.8845.2017_901.doc trial Court on 17.7.2018 at 11am and the trial Court shall rehear and decide the application on or before 31.7.2018. Parties to take note that both the suits are pending since 2012 and hence, they shall cooperate with the trial Court.

Writ Petition is disposed of accordingly.
