Heard learned counsel appearing for the parties. We find that similar application was filed and was rejected by this Court (Coram : P.B. Majmudar & A.A. Sayed, JJ.) in Civil Application No.1791 of 2010 in Writ Petition No.9424 of

rpa 2/2 caw-1297-16.doc 2009 and connected matter vide order dated 11th January, 2011 by directing that the matter be fixed for final hearing on 24th January, 2011. Learned counsel for the applicants submits that thereafter the matter has yet not been listed for final hearing. In view of the aforesaid, we are inclined to dispose of the civil application by directing the registry to list the Writ Petition No.9424 of 2009 for final hearing in the second week of January 2017.
