IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO.4441 OF 2016 Siddhappa Vishwanath Awale

...Petitioner

vs.

The State of Maharashtra

...Respondent

---- None for the Petitioner.

Smt. Aruna S. Pai, APP for the Respondent/State. ---- CORAM : B. P. DHARMADHIKARI & N. R. BORKAR, JJ.

DATE : 24/1/2020.

P.C.:

.

Prisoner has made grievance that because of pendency of another case he was not being considered either for furlough or parole leave.

2.

Learned APP has produced communication sent by Deputy Superintendent of Yerwada Central Prison on 21/1/2020 to the office of Public Prosecutor (Exhibit A) which shows that the other matter is also now disposed of and the punishment imposed is concurrent with earlier punishment.

3.

In this situation, entitlement of the prisoner either to parole or furlough leave can be looked into in accordance with law. 4.

The grievance made by the prisoner therefore does not survive. The petition is therefore disposed of.
