We have carefully perused the averments made in the application filed by the Petitioner which is part of the record of the present writ petition. We are convinced that the prayer of the Petitioner ought to have been considered appropriately by the concerned authority. The reasons given in the order are not convincing and therefore, we are of the opinion that the order passed by the Divisional Commissioner, Nasik dated 04.01.2013 rejecting the application of the Petitioner needs reconsideration. In that view of the matter, we direct the Commissioner Revenue, Nasik Division to consider the grievance of the Petitioner in accordance with law in case the same still subsists within eight weeks from the date of receipt of this order. 2.

With the above observations, the writ petition stands disposed of. 3.

Registry shall send a copy of this order to the concerned Jail
