The Applicant has been convicted by the learned Magistrate for the offence punishable under sections 354 and 504 of the IPC and has been sentenced to suffer RI for a period of six months and pay a fine of Rs. 5000/-. His Appeal has been dismissed by the Sessions Court.
The learned counsel for the Applicant submitted that the Applicant has been falsely implicated by the neighbour because of the civil dispute pending between family of the applicant and the victim. The learned counsel has made out Borey 1/2
spb/ 905appr380-14.sxw an arguable case in the revision application. Therefore, I am inclined to grant bail to the Applicant.
The Applicant be released on bail of Rs.10,000/- with one solvent surety in the like amount or a cash deposit of Rs. 15,000/- in lieu of surety. Substantive sentences imposed on the Applicant shall remain suspended during the pendency of the revision application.
Criminal Application is disposed of in the above terms.
