This is an application under Section 439 of the Cr.P.C. for bail in CR No.198/2016 dated9`` 7.9.2016 registered with BKC Police Station, Mumbai under Section 302, 201 read with 34 of the Indian Penal Code.

The learned counsel appearing for the applicant submitted that the accused Nos. 1 and 2 Anil Kumar Ramkumar Singh and Shivbaksha @ Nanku Verma who have been attributed with the same and/or similar role have been released on bail by this Court by its order dated 8.9.2017 and applicant is therefore, entitled to be released on bail on the ground of parity.

The learned APP. fairly conceded to the said fact situation.

Perused the charge sheet.

After perusing the charge sheet it clearly indicates that the applicant has been similarly situated as that of other two accused persons who have been released on bail by Order dated 8.9.2017 and therefore, applicant is entitled to be released on bail on the ground of parity.

Hence, the following order.

a) The applicant be enlarged on bail, on executing PR bond in the sum of Rs.30,000/- with one or two solvent local sureties in the like amount.

b) The applicant shall report to the Investigating Officer of the concerned police station on the 1st and 3rd Saturday of every month between 10.00 a,.m. to 12.00 noon till the conclusion of the trial.

c) The applicant shall not leave Mumbai without prior permission of the Sessions Court.

d) The applicant to co-operate in the conduct of the trial. e) The applicants shall file an undertaking with regard to clauses (b) and (d) in the Trial Court within one week of their release.

3 /3 f) If there is a breach of any of the aforesaid conditions, the prosecution shall be at liberty to seek cancellation of the applicants' bail.

g) The application is allowed in the aforesaid terms and is accordingly disposed off.
