The challenge in the present proceedings is to an Interim Order passed by the arbitral tribunal on an application filed under Section 17 of the Act. It is informed by the learned counsel for the respondent that already the arbitration proceedings have culminated into a final award, hence, the present proceedings have become infructuous. 2.
It appears that for such reason, the petitioner is not interested to prosecute the present proceedings. Accordingly, disposed of. No costs. 3.
Needless to observe that all contentions of the parties in assailing the arbitral award are expressly kept open.
