The applicant is seeking pre-arrest bail in Crime No. 302 of 2016 registered with Sahar Police Station for the offences punishable under Sections 509, 504 and 506 Indian Penal Code. The Schedule depicts that the offence under above referred sections are bailable. In view thereof, the invoking of provisions of Section 438 Criminal Procedure Code is wholly misplaced. No orders are warranted. The Anticipatory Bail Application is rejected with above observations.
