IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL BAIL APPLICATION NO. 3010 OF 2018 Robinson @ Robin Anthony Lajras ...

Applicant

Versus

The State of Maharashtra ...

Respondent Mr. Nitin B. Kamble for Applicant.

Ms. J. S. Lohokare, APP for Respondent - State. Mr. Chandrakant D. Bhosale, Senior Inspector of Police, Lashkar Police Station, Pune present in Court.

CORAM :

NITIN W. SAMBRE, J.

DATE :

FEBRUARY 20, 2019.

P.C. :

.

The Applicant is seeking regular bail in Crime No. 34 of 2018 for an offence punishable under Section 302 of Indian Penal Code. After the arrest on 12th February 2018 the Applicant came to be chargesheeted. 2.

The learned Counsel for Applicant submits that finger prints of the Applicant are not verified from the cement stone which is used in commission of crime.

2/2 Yadav 14.ba.3010.18 3.

The learned APP submits that there are eye-witnesses to the incident.

4.

Having perused the entire chargesheet, it is voluminous that apart from the fact that there are eye-witnesses who have identified the Applicant in Identification Parade, the incriminating material is seized from the Applicant in the form of blood stained clothes. Apart from above, there is extra-judicial confession also. That being so, there is sufficient material to infer prima facie involvement of the Applicant in the crime in question.

5.

As such, the Criminal Bail Application fails. Hence, the same stands rejected.
