The Learned Counsel appearing on behalf of the Respondent No.4 Ms Irani makes a statement that pending the Suit, the Respondent No.4 would not surrender the tenancy or would not create any third party rights in the respect of the suit premises. Statement accepted. In view of the said statement, the Learned Counsel for the Petitioner seeks withdrawal of the above Petition. The Petition is accordingly dismissed as withdrawn. However, the hearing of the Suit is expedited. Needless to state that the Suit would be tried on its own merits and in accordance with law uninfluenced by the order impugned in the above Petition.
