The respondent is present in Court and tenders a letter dated 7th December, 2016 signed by him and states that without admitting the allegations made by the applicant in this miscellaneous civil application, he has no objection if the petition filed by him i.e. Marriage Petition No.566 of 2015 before the Court of 6th Joint Civil Judge, Senior Division, Thane is transferred to the Family Court, Bandra, Mumbai. The letter addressed by the respondent is taken on record and marked "X" for identification.

In view of the statement made by the respondent in the 1/2
nob5-mca303-15 said letter and across the bar, miscellaneous civil application is made absolute in terms of prayer clause (a). It is directed that the proceedings filed by the applicant and the proceedings filed by the respondent be clubbed and heard together by the Family Court, Bandra, Mumbai.

The parties as well as the two Courts below described in prayer clause (a) to act on the authenticated copy of this order. 5.
The parties are directed to appear before the Family Court, Bandra, Mumbai on 16th January, 2017.

Miscellaneous Civil Application No.303 of 2015 is disposed of in aforesaid terms. No order as to costs.
