This is an application for modification of condition No.3 imposed upon the applicant by Order dated 14.10.2016 by the Additional Sessions Judge, Mumbai in BA No.558 of 2016. 2.

The learned counsel for the applicant submitted that the applicant is seriously complying with the said condition. He further submitted that the applicant has filed Cri. W.P. No.787/2017 for quashing of FIR and the Division Bench of this Court by an order dated 2.3.2017 was pleased to grant ad-interim relief thereby directing that though the investigation shall continue, charge sheet shall not be filed as against the petitioner. The said order is annexed

2/2 APPLN. 696-17 at Page 27 to the present application. As the submission of charge sheet has been stayed by this Court by its Order dated 2.3.2017, I am inclined to relax the condition of attendance of the applicant to the concerned police station.

In view thereof, the condition No.3 imposed by the applicant by impugned Order dated 2.3.2017 is hereby waived. 4.
