The learned Counsel for the respondents, on instructions, submits that the petitioner has also fled appeal before the School Tribunal, Kolhapur challenging the termination order. The petitioner is terminated under order dated 1st December 2013. In the said writ petition, the petitioner may set up a case of arrears of salary from 1st December 2013.

The learned Counsel for the petitioner submits that the petitioner has become disabled to the extent of 43% on account of accident. The petitioner may raise this plea before the School Tribunal.
