Perused affidavit of undertaking tendered during the hearing, signed by the Applicant alongwith his wife Saraswati, daughter Shruti and son Shreyam.
Since the subject matter in the crime in question is already secured, in my opinion, the custodial interrogation of the Applicant is not warranted.
It is informed by the parties i.e. the Applicant and the Complainant that they will be initiating Civil proceedings inter-say in regard to the property which is the subject matter of crime in question.
That being so, in the event of arrest in crime no. 53 of 2018 registered with Malbar Hill Police Station for offence punishable
3 923.2321.19 aba.doc under Sections 406, 420 r/w 34 of the Indian Penal Code, the Applicant be released on furnishing P.R. Bond in the sum of Rs. 25,000/- with two sureties in the like amount. The Applicant shall not influence or tamper with the evidence. The Applicant shall attend the Investigating Officer on 26/11/2018, 28/11/2018 and 30/11/2018 between 10.00 a.m. to 12.00 noon and thereafter, as and when directed by the Investigating Officer. The aforesaid undertaking will be subject to outcome of the Civil proceedings between the parties.
Application stands disposed of.
