Heard learned counsel for the petitioner.

By this petition, the petitioner has impugned the order dated 7th October, 2017, passed by the learned Additional Sessions Judge, Kolhapur, in Criminal Appeal No.159 of 2017. 3.

Learned Counsel for the petitioner submits that the learned Judge ought to have directed the respondent-accused to deposit some percentage of the compensation amount while suspending the conviction

Without going into the legality of the order, considering the amount involved, it would be appropriate to direct the learned Additional Sessions Judge, Kolhapur to decide the Criminal Appeal No.159 of 2017, itself as expeditiously as possible and preferably within six months from the date of receipt of this order. All contentions of both the parties are kept open. It is made clear, that this petition has not been heard on merits. 5.

Petition is accordingly disposed of on aforesaid terms. 6.
