This is an application for modification of order dated 28.1.2015 passed in Bail Application No.2371 of 2014.

By the said order, while releasing the applicants on bail, this Court had imposed the condition that the applicants shall attend the Investigating Officer on every Monday between 5.00 p.m. to 7.00 p.m. until further orders. The learned Counsel for the applicants submits that since their release, the applicants are sincerely following the said condition. He submits that as of date the trial pertaining to CR No.I-78 of 2014 is not yet commenced. In the situation, he prayed that the said condition may be modified. The learned APP submits that

Dond 2/2 appp.1063-2015.sxw appropriate orders may be passed in the interest of justice. Taking into consideration the fact that the applicants are regularly attending the Investigating Officer since their release, I am inclined to modify the said condition in the interest of justice.

Hence, the following order:- The condition no.2 in order dated 28.1.2015 is hereby modified and the applicants are directed to attend the Investigating Officer on every first Monday of the month between 5.00 p.m. to 7.00 p.m. till the conclusion of the trial. The rest of the conditions imposed upon the applicants by order dated 28.1.2015 are not disturbed. The application is allowed in the aforesaid terms. (A.S. GADKARI, J.)
