By this petition under Articles 226 & 227 of the Constitution of India, the petitioner has challenged the judgment and order dated 20/11/2012 passed by the learned Judicial Magistrate, First class, Ulhasnagar, below Exhibit 30 in M.A. No. 236 of 2009. By that order, the prayer of the petitioner for dismissing the application made by the respondent No.1 under section 125 of the Code of Criminal Procedure, 1973 was rejected by the learned Magistrate.

After arguing the petition for some time, Mr.Gawada, upon taking instructions by the petitioner who is present in the Court, seeks permission to withdraw this petition.

On the motion made by Mr.Gawada, petition is allowed to be withdrawn and is dismissed as withdrawn.
