P.C.:- This is a subsequent Application for bail.

The earlier Application for bail was dismissed, as withdrawn, by this Court by an Order dated 7th September 2016. Except the fact of passage of time, there is no other change in circumstance of the present case.

The learned APP, on instructions, submitted that, the trial of the present case has already began and one witness has been examined. He submitted that, the prosecution may further examine approximately 12 witnesses in support of its case. In view thereof, the learned counsel for the Applicant seeks leave to withdraw the present Application with liberty to file a 1/2

ssm 2 42-ba2858.17.sxw fresh Application for bail before the Trial Court, if the trial arising out of CR No. 444 of 2015 registered with Dahisar Police Station, Mumbai does not conclude within a period of six months from today. Leave and liberty granted.

Application is disposed of as withdrawn, with aforesaid liberty.
