1] This is an application for temporary bail in CR No.2 of 2017 registered with RPF Station, Kurla, Mumbai under Section 3(a) Railway Property (Unlawful Possession) Act, 1966.
2] The applicant has categorically stated that, his unmarried daughter Miss. Mehajabeen Mohiddin Sayed expired on 8th November 2017 and her last rituals as per Islam religion will have to be performed on 14.12.2017. A death certificate dated 22.11.2017 is annexed to the present application at page 22.
3] In view of the above, applicant is granted temporary bail for a period of 7 days from 13.12.2017 to 20.12.2017. 1/2

(i) Applicant be released on temporary bail in CR No.2 of 2017 registered with RPF Police Station, Kurla, Mumbai for a period of 7 days from 5.00 p.m of 13th December 2017 till 5.00 p.m of 20th December 2017 on his furnishing PR bond of Rs.15,000/- with an undertaking that applicant shall surrender to the jail authority on or before 5.00 p.m of 20th December 2017.
(ii) The jail administration is directed to release the applicant from jail custody on or before 5.00 p.m on 13th December 2017 on production of authenticated copy of this Order with aforestated undertaking. (iii) Applicant shall surrender before the Jail Authority on or before 5.00 p.m. of 20th December 2017.
4] It is made clear that the present application is decided only in the context mentioned above for temporary bail and the applicant is at liberty to file regular bail application on merits after 21.12.2017. 5] Application is allowed in the aforesaid terms.
